For a number of years. this Blog has published semi-annually those Panelists at The FORUM and at WIPO who have been the fairest with the least bias against Domain Investors. For the last 6 months, we have recorded every decision by every panelist used by The FORUM with some extremely amazing results. the first thing that we discovered is that The FORUM has only used 29 Panelists to decide a total of 1,261 UDRP Claims. Of that total, 1,192 (94.5%) were uncontested default cases. Of those default cases, 1,160 (97.3%) were transfers, with 32 Denials and 3 findings of abuse of the system by Complainants (RDNH).
The GOOD news for investors is that of the 69 contested claims, only 47 (68%) were transferred with 22 Denials and 1 RDNH. Curiously, there were more findings of RDNH on the uncontested cases. So, of the 1,261 claims adjudicated at The FORUM, 1,207 (95.7%) were transferred, while 54 (4.3%) were denied with 4 RDNH findings.
Now here is the really interesting fact: of the 1,192 uncontested cases, 1,034 were decided by 11 Panelists! The other 18 Panelists only decided 158 cases. With all of the Panelists to choose from, one has to ask why The FORUM has such an unbalanced case load. And here is the real kicker. RICHARD HILL is indeed KING OF THE HILL. From July 1 to December 31 is 184 days. In that time RICHARD HILL rendered 174 Transfer Decisions and 5 Denials. That’s 179 Decisions!!!! And 2 of them were 3 person panels. How is that possible?
